Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Rodrigo Lopez Lacuague (an individual, based in Uruguay) (“Habitants”, “we”, “us”) governing your use of the Habitants iOS app and the website at habitants.app (the “Service”). By using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.

1. Who can use Habitants

You must be at least 13 years old (or the minimum age required in your country — 16 in parts of the EEA). If you’re under the age of majority, you may use the Service only with a parent or guardian’s consent.

2. What Habitants is

Habitants is a lightweight habit tracker: you log habits, build streaks and consistency, earn XP and badges, optionally track with groups or a partner, and use optional AI helpers. Habitants is for general self‑improvement only. It is not medical, psychological, or professional advice, and is not a substitute for care from a qualified professional. Don’t rely on it for health decisions.

3. Your account

You sign in with Apple or Google. You’re responsible for keeping access to your sign‑in method secure and for activity under your account. Provide accurate information and let us know of any unauthorized use.

4. Acceptable use

You agree not to:

  • break the law or infringe others’ rights using the Service;
  • harass, abuse, or harm other members in groups, or share content that is illegal, hateful, or infringing;
  • attempt to access others’ data, disrupt or overload the Service, or bypass security;
  • reverse‑engineer, scrape, or copy the Service except as the law allows; or
  • misuse invite links or impersonate others.

We may suspend or terminate accounts that violate these Terms.

5. Your content

You keep ownership of the habits, notes, and other content you create (“Your Content”). You grant us a limited, worldwide, royalty‑free license to host, store, process, and display Your Content solely to operate and improve the Service for you — including syncing it, generating your AI results, and showing content you choose to share with a group to that group’s members. We don’t sell Your Content or use it for advertising.

You’re responsible for what you share in groups. Anything you share in a group is visible to that group’s members.

6. Habitants Pro (subscriptions)

Some features require a paid subscription, Habitants Pro, sold as an auto‑renewing subscription through the Apple App Store.

  • Billing & renewal. Payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. The exact price and length are shown in the app before you buy.
  • Managing & cancelling. Manage or cancel anytime in your Apple ID settings (Settings → your name → Subscriptions). Deleting the app does not cancel a subscription.
  • Refunds. Purchases are handled by Apple; refund requests are subject to Apple’s policies.
  • Free features. Core habit tracking is free; we may change which features are free or Pro, and may change prices on a going‑forward basis with notice as required.

7. AI features

Optional AI features generate text (such as habit suggestions and weekly summaries) using a third‑party AI provider. AI output can be inaccurate, incomplete, or not right for you — treat it as a helpful suggestion, not advice, and use your own judgment. See the Privacy Policy for what data these features use.

8. Intellectual property

The Service — including the Habitants name, logo, the “Ant” character, the jewel design, software, and content we provide — is owned by us or our licensors and protected by law. We grant you a personal, non‑exclusive, non‑transferable, revocable license to use the Service as intended. All rights not granted are reserved.

9. Third‑party services

The Service relies on third parties (e.g., Apple, Google, and our infrastructure providers). Your use of their services may be subject to their own terms, and we aren’t responsible for them.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law. We don’t warrant that the Service will be uninterrupted, error‑free, or that data will always be available or accurate.

11. Limitation of liability

To the fullest extent permitted by law, Habitants and its operators won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or USD $50. Some jurisdictions don’t allow these limits, so they may not fully apply to you.

12. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your misuse of the Service or violation of these Terms, to the extent permitted by law.

13. Termination

You may stop using the Service at any time and request account deletion (see the Privacy Policy). We may suspend or end your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive (ownership, disclaimers, liability limits) will survive termination.

14. Apple App Store

These Terms are between you and Habitants, not Apple. Apple has no obligation to provide maintenance or support for the app. Apple is not responsible for any product warranties or for addressing any claims relating to the app (including product‑liability, legal/regulatory, or consumer‑protection claims). In case of any third‑party intellectual‑property claim relating to the app, Apple is not responsible. You represent that you are not located in a country subject to a U.S. embargo or designated as “terrorist‑supporting,” and are not on any U.S. prohibited‑parties list. Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them against you. You must also comply with applicable third‑party terms (e.g., your wireless carrier’s) when using the app.

15. Changes

We may update these Terms. For material changes we’ll update the date above and provide reasonable notice. Continuing to use the Service after changes take effect means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of Uruguay, without regard to conflict‑of‑laws rules, except where mandatory consumer‑protection laws of your country of residence apply.
